Terms of Service

1. About This Agreement

Back n Forth provides its services to you through our website, gobacknforth.com (the “Platform”) and any related services. This includes, but is not limited to our online engagement tools, products, and content (“Service(s)”), which are subject to the following Terms of Service (as amended occasionally, the “Terms”). By accessing any part of the Platform and Services, you are agreeing to the Terms and conditions described here, our Privacy Statement, and any other legal notices published by us on the Platform or Services. If you do not agree to these Terms, you should not use the Platform and Services. These Terms apply to all users, including website visitors, users who have registered (“Creator(s)”) and users who browse and make payments (“Supporter(s)”).

2. Accounts

To use the Platform and Services, Creators will be required to create an account. When you create an account you represent and warrant that you are at least 18 years of age. You are responsible for providing and maintaining accurate and updated personal information, and for safeguarding your account information. You may not select or use an identity of another person with the intent to impersonate that person. You must not create an account if you have previously been removed or banned from our Platform and Services. You must use a valid email address, and Back n Forth reserves the right to verify this at any time. Back n Forth will not be liable for any loss or damage that arise from your failure to comply with the above requirements.

Your account is strictly personal and shall not be used by any other person without your supervision. Neither shall you assign your account to any other person. You are in any event solely responsible for the use of the Platform and Services through your personal user account.

Back n Forth may change, terminate, or restrict access to any aspect of the Platform, Service, or your account, at any time, without notice. We reserve the right to impose limitations of use based on what we consider fair or legitimate usage.

You are responsible for your use of Back n Forth, including the lawfulness of any content displayed, shared, uploaded or otherwise made available by you in the Platform and Service.

Your use of Back n Forth requires that you have hardware, software and an internet connection fulfilling certain requirements. If the recommended requirements are not met, you may still use the Platform and Service, but normally with a lower quality or performance. Such reduced quality or performance will not give you the right to claim any compensation from Back n Forth.

3. Back n Forth Services

Back n Forth does not own, create, sell, resell, provide, control, manage, offer, deliver, or supply any Creator or Supporter Content (defined below). When a Creator offers an engagement that a Supporter submits to, they are entering into a contract directly with each other. Back n Forth is not and does not become a party to or other participant in any contractual relationship between Creators and Supporters. Back n Forth is not acting as an agent in any capacity for any Creator or Supporter, except for collecting Service fees.

Back n Forth has no control over and does not guarantee (i) the trust or accuracy of any Creator’s engagement descriptions, online ratings, or online reviews, or (ii) the performance or conduct of any Creator, Supporter, or third party. Back n Forth does not endorse any Creator’s engagement listing or content. Any reference to a Creator in marketing Content only indicates that the Creator has completed a relevant verification or identification process and has completed successful engagements in the past. Any such use is not an endorsement, certification, or guarantee by Back n Forth for any Creator, including the Creator’s identity or background, or whether the Creator is trustworthy, safe, or suitable.

Back n Forth reserves the right to refuse to provide our Platform and Services to any person, including Creators, for any reason and/or to discontinue the Platform and Services in whole or in part at any time, with or without prior notice.

4. Intellectual Property Rights

Content, Technology, and Trademarks. You acknowledge and agree that the Services may contain content or features that are protected by copyright, patent, trademark, trade secret, or other proprietary rights and laws. Except as expressly authorized by Back n Forth, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute, or create derivative works based on the Platform and Services, except that the foregoing does not apply to your own Creator or Supporter content that you legally create or upload to the Platform or Service. In connection with your use of the Platform and Services you will not engage in or use any data mining, robots, scraping, or similar data gathering or extraction methods. If you are blocked by Back n Forth from accessing the Platform and Services for any reason, you agree not to implement any measures to circumvent such blocking. Any use of the Services or the Platform other than as specifically authorized herein is strictly prohibited. The technology and software underlying the Platform or Services or distributed in connection are the property of Back n Forth (“Technology”). You agree not to copy, modify, create a derivative work of, reverse engineer, reverse assemble, or otherwise attempt to discover any source code, sell, assign, sublicense, or otherwise transfer any right in the Technology. Any rights not directly granted are reserved by Back n Forth. The Back n Forth name and logos are protected by copyright. Nothing in these Terms or the Platform and Services should be construed as granting any license or right to use any Back n Forth copyright without our prior written permission in each instance.

Third Party Material. Under no circumstances will Back n Forth be liable for content or materials of third parties (including Creators or Supporters), including, but not limited to, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any such content. You acknowledge that Back n Forth does not pre-screen content, but that Back n Forth will have the right (but not the obligation) in our discretion to remove any content that is made available via the Platform and Services. You agree that you must evaluate, and bear all risks associated with, the use of any content, including the accuracy, completeness, or usefulness of such content.

User Content. With respect to the content or other materials you upload to the Platform and Services or share with other users or recipients (collectively, “ User Content”), you warrant that you own all rights to do so without violation of any third-party rights. By generating or uploading any User Content, you grant to Back n Forth a nonexclusive, worldwide, royalty free, fully paid up, transferable, sublicensable, perpetual, irrevocable license to copy, display, upload, adapt, perform, publish, distribute, store, modify, and otherwise use your User Content in any and all media, form, technology, or distribution methods known now or later developed and for any and all purposes. You acknowledge and agree that any questions, comments, ideas, feedback or other information relevant to the Platform and Service (“Suggestion(s)”), provided by you to Back n Forth are non-confidential and Back n Forth is entitled to the unrestricted use and dissemination of these Suggestions for any purpose, commercial or otherwise, without acknowledgement or compensation to you. You acknowledge and agree that Back n Forth may preserve content and may also disclose content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (i) comply with legal process, applicable laws, or government requests; (ii) enforce these Terms; (iii) respond to claims that any content violates the rights of third parties; or (iv) protect the rights, property, or personal safety of Back n Forth, its users, and the public. You understand that the technical processing and transmission of the Platform and Services, including your content, may involve transmission over various networks and changes to conform to technical requirements of connecting networks or devices.

Health and Medical Disclaimer. Back n Forth is not to be used to provide any physical or medical advice. You agree to consult your healthcare provider before initiating any physical exercises or wellness practices provided through User Content, and follow your provider’s advice accordingly. You also acknowledge and agree to accept the inherent risks and dangers in participating in any such physical exercises or wellness practices. You agree that Back n Forth will not be liable for any injury, loss, or damages that arise from your access or practice of any User Content.

Copyright Complaints. Back n Forth respects the intellectual property of others. If you believe in good faith that any content on the Platform and Services infringe upon your copyrights, please send the following information to Back n Forth at support@gobacknforth.com.

1. An electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Back n Forth to locate the material.
4. Information reasonably sufficient to permit Back n Forth to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party must be contacted.
5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Only notices emailed to support@gobacknforth.com will be accepted. All other inquiries or requests will be discarded. Upon receiving a complaint related to copyright infringement, Back n Forth may remove the content identified as being infringing. In addition, Back n Forth may, but is under no obligation to, terminate the account of the party that appears to be the infringer.

5. User Obligations

When you register an account and/or use the Platform and Services, you agree:

1. To use the Platform and Services only for lawful purposes and agree to not use the Platform and Service in any way that will infringe upon the use or rights of any other party.
2. Your use of the Platform and Services is subject to all applicable laws and regulations, and you are solely responsible for the substance of your communications and content through the Platform and Services.
3. To not upload any copyrighted, trademarked, or proprietary materials on the Platform and Services without the expressed permission of the owner. You will not post any content that infringes on any patent, trademark, trade secret, copyright, right of publicity, or other intellectual property or proprietary right of any party.
4. To assume full responsibility for any uploaded User Content.
5. That certain content is posted publicly and may be viewed and accessed by other parties.
6. That you will not engage in any behavior that constitutes unauthorized or unsolicited advertising, junk or bulk email (also known as “spamming”), chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling.
7. You agree, acknowledge, represent and warrant that procurement of any email addresses, phone numbers, or personal information through our Platform and Services shall be done after obtaining all necessary consents and authorizations under, and will be in full compliance with, applicable laws and regulations, including without limitation to the Controlling the Assault of Non-Solicited Pornography and Marketing Act and the Children's Online Privacy Protection Act, and those issued by the Federal Trade Commission, Federal Communications Commission, and laws related to anti-spam, text messages and Do-Not-Call Registries.
8. You will not upload, share, post, distribute, link to, promote, endorse, or otherwise partake in any behavior that is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), or otherwise violates our rules or policies.
9. You acknowledge and agree that when you use the Platform or Services to communicate, we may automatically scan and may manually filter messages to check for spam, viruses, phishing attacks and other malicious activity or illegal or prohibited content.
10. You will not share personal information about others, without their consent.
11. You will not partake in any behavior that victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability.
12. You will not share content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any third party.
13. You will not impersonate any person or entity, including any of our employees or representatives.
14. You will not use your account to breach security of another account or attempt to gain unauthorized access to another network or server. You shall not interfere with anyone else’s use and enjoyment of the Platform and Service. Users who violate systems or network security may incur criminal or civil liability.

Back n Forth reserves the right to report illegal activity to applicable local authorities.

6. Creator Obligations

When you publish content on the Platform or Services, you:

1. Will honor any and all enrollments on the Platform and Services at the price and time listed in the Services, and to not refuse enrollments or participation by any Member for any discriminatory or illegal reason.
2. Agree that any content you submit, post, publish, or otherwise disseminate to the Platform and Service will not contain third party copyright, or material that is subject to other third party proprietary rights, unless you have permission from the rightful owner of the material.
3. Represent and warrant to Back n Forth that you will at all times conduct yourself in compliance with all applicable laws, regulations, court orders, third party rights, applicable industry requirements, and any Back n Forth policy or standard that may be issued.
4. You will not require or suggest that a Supporter agrees to any terms that reduce or limit Back n Forth’s refund policy.
5. Understand that Supporters will have the ability to share and post an engagement or a review of your engagement. We cannot control the contents of such, and will not be held responsible for any information or opinions that a Supporter may share.
6. In the event you provide any personal information of any other individual while using the Back n Forth Platform or Services, you must have provided any such notice to data subjects that may be required under applicable law and, to the extent required under applicable law, established a legal basis for your use of such personal data.
7. You agree that if you collect personal information about Supporters through the Platform or Services, including in connection with a purchase, you must provide the Supporter a chance to remove themselves from your database and a chance to review what information you have collected about them. In addition, you agree that you will use personal information you receive through the Platform or Services only for: Back n Forth transaction-related purposes that are not unsolicited commercial messages; further business offered through the Back n Forth Platform and Services, or other purposes that a User expressly chooses.
8. May choose to remove engagements, but we will continue to have the right to store previously completed engagements and provide them to Supporters who paid for them.
9. You will promptly respond to inquiries from Back n Forth and notify Back n Forth of any regulatory or legal complaints, and threats of such complaints that you receive in connection with or in relation to using our Platform and Services.

7. Supporter Obligations

When you access User Content, you agree:

1. To be respectful of others and to not take any actions to interfere with any other user’s enjoyment of the Platform and Services.
2. To not copy any materials or techniques for your own commercial use.

Back n Forth reserves the right to delete or suspend any access if we determine, in our sole discretion, that a Supporter has violated any of the obligations described herein.

8. Service Fees

Back n Forth may charge fees to Creators ("Creator Fees") and/or to Supporters ("Supporter Fees") (collectively, "Service Fees") in consideration for the use of the Platform and Services. When listing an engagement or making a payment, you agree to pay all amounts due in accordance with the Terms in effect when the transaction takes place (including any applicable service, transaction, or processing fees).

Back n Forth reserves the right to change the Service Fees at any time, and fees may be subject to change without notice. Such fee changes will not affect any purchases made prior to the effective date of the fee change.

Payment processing services for Back n Forth, including the processing and storing of credit card data, are provided by Stripe Inc. (“Stripe”) and are subject to the Stripe Services Agreement. By agreeing to these Terms and continuing to use Back n Forth, You agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of Back n Forth enabling payment processing services through Stripe, you agree to provide Stripe and Back n Forth accurate and complete information about you and your business, and any transaction information related to your use of the payment processing services provided by Stripe.

9. Refunds

All payments are non-refundable unless authorized by the Creator, authorized by Back n Forth for any reason deemed appropriate, or otherwise required by applicable law.

If you believe there are special circumstances and would like to request a refund. Please email support@gobacknforth.com to request a refund. Please explain in sufficient detail why you are requesting a refund.

10. Communications

Back n Forth may need to send you information about the Platform and Service, such as important service announcements and administrative messages, by email or other means of electronic communication, by posting a notice on the Website, or through any other relevant communication channels.

Back n Forth may offer to send you promotional information by email or other means of electronic communication. You may choose to opt out to receiving such communication at any time.

11. Termination

You may stop using our Platform and Service by contacting Back n Forth at support@gobacknforth.com, and requesting account deletion.

12. Disclaimer of Warranties

Back n Forth provides the Platform and Services to you “as is”. You acknowledge that the Platform and Services are not error-free. You use it at your own risk and discretion. That means the Platform and Services do not come with any warranty. None express, none implied. The Platform and Services will be continually developed, and you acknowledge that changes to functionality and layout may be carried out without advance notice. Back n Forth makes no warranties, expressed or implied, with respect to the availability, merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, performance and quality of the Platform and Services. Back n Forth will from time to time have to carry out updates and maintenance of the Platform and Services, due to technical, security or operational reasons, during which time the Platform and Services might be unavailable. Back n Forth will make reasonable efforts to arrange updates and maintenance outside of peak usage hours.

13. Limitation of Liability

In no event shall any Back n Forth party, or its heirs, successors and assigns, be liable to you or any third party for any special, punitive, incidental, indirect or consequential damages of any kind, or any damages whatsoever, including, without limitation, those resulting from loss of use, data or profits, whether or not we have been advised of the possibility of such damages, and on any theory of liability, arising out of or in connection with the use of the Platform and Service or of any website referenced or linked to from the Platform or Service.

Further, Back n Forth shall not be liable in any way for any engagement, third party goods, and services offered through our Platform or Service or for assistance in conducting commercial transactions with other users of the site, including without limitation any transaction between a Creator and Supporter.

Back n Forth makes no representations or warranties about the accuracy or completeness of content available on or through our Platform or Services or the content of any social media platform or third-party platform linked to or integrated with our Platform or Services. You acknowledge and agree that Back n Forth will have no liability for any: (i) errors, mistakes, or inaccuracies of content; (ii) personal injury, property damage, or other harm resulting from your access to or use of our Platform or Services; (iii) any unauthorized access to or use of our servers, any personal information, or user data; (iv) any interruption of transmission to or from our Platform or Services; (v) any bugs, viruses, trojan horses, or the like that may be transmitted on or through our Platform or Services; or (vi) any damages, losses, costs, expenses, or liabilities of any kind incurred as a result of any content posted or shared through our Platform or Services.

You acknowledge and agree that any material or information downloaded or otherwise obtained through our Platform or Services is done at your own risk and that you will be solely responsible for any damages, losses, costs, expenses, or liabilities arising from or in connection with doing so. No advice or information, whether oral or written, obtained by you from us or through our Platform or Services will create any warranty not expressly made by us.

You acknowledge and agree that when using our Platform or Services, you will be exposed to content from a variety of sources, and that Back n Forth is not responsible for the accuracy, usefulness, safety, legality, or intellectual property rights of or relating to any such content. You further understand and acknowledge that you may be exposed to content that is inaccurate, offensive, indecent, objectionable, or harassing, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Back n Forth.

To the maximum extent permitted by applicable law, our total cumulative liability to you or any third party under these Terms, including from all causes of action and all theories of liability, will be limited to and will not exceed the fees actually received by Back n Forth from you during the 12 months preceding the claim giving rise to such liability.

Certain jurisdictions do not allow the exclusion or limitation of certain damages. If those laws apply to you, some or all of the above exclusions or limitations may not apply to you, and you might have additional rights.

14. Indemnification

You agree to defend, indemnify, and hold Back n Forth and its partners, affiliates, officers, directors, employees, representatives, agents, attorneys, heirs, successors, and assignees harmless from and against any and all suits, actions, claims, proceedings, damages, settlements, judgments, injuries, liabilities, obligations, losses, risks, costs, and expenses (including, without limitation, attorneys’ fees and litigation expenses) relating to or arising from your use of the Platform or Service, your fraud, violation of law, or willful misconduct, any breach by you of these Terms or your violation of any rights of any other person or entity. We reserve the right to control the defense of any claim by a third-party for which we are entitled to indemnification, and you agree to provide us with such cooperation as is reasonably requested by us.

15. Legal Disputes

If a dispute arises between you and Back n Forth, our goal is to provide you with a neutral and cost-effective means of resolving the dispute quickly. Accordingly, you and Back n Forth agree that we will resolve any claim or controversy at law or equity that arises out of these Terms or our Platform or Services in accordance with one of the means below or as we and you otherwise agree in writing. Before resorting to these alternatives, we strongly encourage you to first contact us directly by email at support@gobacknforth.com to seek a resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

These Terms shall be governed in all respects by the laws of Back n Forth's local jurisdiction as they apply to the Terms entered into and to be performed entirely within Back n Forth's local jurisdiction, without regard to conflict of law provisions. You agree that any claim or dispute you may have against Back n Forth must be resolved exclusively by a court located in Back n Forth's local jurisdiction, except as otherwise agreed by the parties or as described in the Arbitration Option paragraph below. You agree to submit to the personal jurisdiction of the courts located within Back n Forth's local jurisdiction for the purpose of litigating all such claims or disputes.

For any claim (excluding claims for injunctive or other equitable relief) where the total amount of the award sought is less than $10,000, the party requesting relief may elect to resolve the dispute in a cost-effective manner through binding non-appearance-based arbitration. In the event a party elects arbitration, they shall initiate such arbitration through an established alternative dispute resolution (“ADR”) provider mutually agreed upon by the parties. The ADR provider and the parties must comply with the following rules: (i) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by the party initiating the arbitration; (ii) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and (iii) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction

All claims you bring against Back n Forth must be resolved in accordance with this Legal Disputes section. All claims filed or brought contrary to the Legal Disputes section shall be considered improperly filed. Should you file a claim contrary to the Legal Disputes section, Back n Forth may recover attorneys' fees and costs up to $1,000, provided that Back n Forth has notified you in writing of the improperly filed claim, and you have failed to promptly withdraw the claim.

16. Miscellaneous

Governing Language. These Terms are in English and all disputes between the parties shall be resolved in English. You understand and acknowledge that any foreign language services provided by Back n Forth are for informational purposes only and it is your obligation to obtain independent legal advice at your own expense to ensure you understand the Terms.

Notices. Any notices to you from Back n Forth regarding the Platform or Services or these Terms may be made by email, a posted notice on the Platform or Services, or regular mail, in our sole discretion.

Confidentiality and Non-disclosure Obligations Back n Forth may disclose to you and/or you may otherwise receive or have access to sensitive, confidential, and/or proprietary information of Back n Forth (collectively, “Confidential Information”). Except as required to perform your obligations under and in accordance with the Terms, you shall not disclose or use the Confidential Information, without the express prior written consent of Back n Forth. You may not use any Confidential Information for the purpose of soliciting, or to permit others to solicit, Users to subscribe to any other services or promote the sale of any products that compete, either directly or indirectly, with Back n Forth or the functionality offered by the Platform or Services.

Electronic Communications. When you access or use the Platform or Services or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you via email or through the Platform and Services. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You further agree that any notices provided by us electronically are deemed to be given and received on the date we transmit any such electronic communication as described in these Terms.

Entire Agreement. These Terms and any other agreements Back n Forth may post on the Platform or Services, or that you and Back n Forth may execute from time to time constitute the entire Terms between Back n Forth and you in connection with your use of the Platform or Service and supersede any prior Terms between Back n Forth and you regarding use of the Platform and Services, including prior versions of these Terms.

Assignment. Back n Forth may freely assign or transfer any or all of the rights and obligations described in these Terms, or these Terms in its entirety in connect with a merger, acquisition, or sale of assets or by operation of law or otherwise. You may not assign these Terms or any of your rights and duties hereunder without the prior written consent of Back n Forth. These Terms shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns.

Severability. All parts of these Terms apply to the maximum extent permitted by law. Our failure to enforce any provision of these Terms will not constitute a waiver of such right. We both agree that if we cannot enforce a part of these Terms as written, then that part will be replaced with terms that most closely match the intent of the unenforceable part to the extent permitted by law. Except as otherwise provided in the Terms, the invalidity of part of this Terms will not affect the validity and enforceability of the remaining provisions. The section headings are for convenience and do not have any force or effect.

Publicity. You may not issue or make any publicity release (including press releases and advertising or solicitation materials) or other public statement: (i) relating to these Terms; (ii) using Back n Forth's name or referencing the Platform or Services; or (iii) suggesting or implying any endorsement by Back n Forth of you and/or your services without the prior written approval of Back n Forth, which Back n Forth may withhold in its sole discretion.

No Agency Relationship. Neither these Terms, nor any content, materials or features of the Platform or Services create any partnership, joint venture, employment, or other agency relationship between you and Back n Forth. You may not enter into any contract on our behalf or bind us in any way.

Links. Our Platform and Services may contain links to social media platforms or third-party websites. You acknowledge and agree that: (i) the link does not mean that we endorse or are affiliated with the platform or website; and (ii) we are not responsible or liable for any damages, losses, costs, expenses, or liabilities related to your use of the platform or website. You should always read the terms and conditions and privacy policy of a platform or website before using it.

Force Majeure. Neither you nor Back n Forth shall be responsible for delays or failures in performance resulting from strikes, lockouts, riots, acts of war and terrorism, embargoes, boycotts, changes in governmental regulations, epidemics, fire, communication line failures, power failures, earthquakes, other disasters or any other reason where failure to perform is beyond the control of, and not caused by, the non-performing party.

Equitable Actions. You acknowledge and agree that any breach or threatened breach of these Terms may cause immediate and irreparable harm to Back n Forth which would not be adequately compensated by monetary damages and that Back n Forth may seek injunctive relief, specific performance, and/or other equitable relief as a remedy for any such breach or anticipated breach without the necessity of posting a bond or other security. Notwithstanding any other provision of these Terms, any such relief may be sought in Back n Forth's local jurisdiction or any other court of competent jurisdiction anywhere in the world (at Back n Forth's sole discretion), and, you hereby consent to the jurisdiction of any such court and waive any objection to venue laid therein. Any such relief shall be in addition to and not in lieu of any appropriate relief in the way of monetary damages.

Choice of Law. The Terms shall be governed by and interpreted in accordance with the law of which Back n Forth is located. Any dispute, controversy or claim arising out of or in connection with the Terms shall be subject to the jurisdiction of the courts in which Back n Forth is located.

Heading interpretation. The section headings are for convenience only and shall not control or affect the meaning or construction of any provision of these Terms.
